In 1999 air filtration companies worked with various metroplex cities to establish guidelines backed up by research and technology, so that smokers and non-smokers could co-exist in restaurants. Unfortunately resuatrants have not complied because of their failure to maintain air filtration systems to provide adequate safe-air quality for non-smokers in the non-smoking areas. Further they have failed to enforce the ban on smoking in non-smoking areas. Had they complied, this would not have become an issue again today. No one has the right to force unhealthy conditions through second hand smoke any more than they have the right to serve spoiled or unhealthy food. Your arguements coule just as easily be used to argue that there is no need for health inspectors since people have the right to choose by their feet to not go to restaurants that serve unhealthy food! The government has a responsibility for health and safety. The presumption is that if the government allows a business to serve food that both the food and the environment pass some minimum health code.

Yes the restaurant owners have the ability to control their enclosed environment, but they don't.
If it were not for food safety laws, I believe restaurant owners would risk serving bad food occassionally just to save a buck!

Your arguments are valid, in fact we should do away with speed limits on freeways and everyone should be able to choose where they want to drive, whether with or without speed limits! Then we should arrest the people who drive too fast and kill others, just as we do with DWI/DUI violators. Why should the government restrict responsible drivers just to control the irresponsible ones? We should have a choice.

You are right where does the government have the right to increase building costs that keep people from opening businesses just by putting in building codes.
Let people vote with their feet and not go to buildings that aren't government inspected. Then let the patron sue if the building falls down! Let people vote to patronize businesses that have inspected buildings if that's what they want!
