The family of a 13-year-old Austin girl who says she was sexually assaulted by a 19-year-old man whom she met online. The girl alleges Pete Solis of Buda lied in his MySpace profile about being a senior on the football team to gain her trust and phone number. Solis was arrested in Mayon a charge of sexual assault of a child.
In a ruling issued yesterday, U.S. District Judge Sam Sparks said MySpace is protected under the Communications Decency Act. It cannot be expected to verify the age of every user because that ``would of course stop MySpace's business in its tracks.''
The decency act cited by Sparks generally grants immunity to interactive computer services such as MySpace so that they are not liable for content posted by users.
An attorney for the girl and her family said they will file an appeal. Attorney Jason Itkin says the decision allows sites like MySpace to avoid the responsibility to make the Internet safe for children.

You live in a house that never flooded in its history and along comes a 8 foot mountain of dirt piled behind your house and now every time it rains the hose floods. My 2 year old grandson would be able to tell you why; the 8 FOOT MOUNTAIN of DIRT is why. So I guess that leads us to believe that the Dallas City officials do not have the intelligence of a 2 year old.
If I lived in that neighborhood I think I would be handing out flyers describing what the problems and do they want to risk a possible legal battle. If enough people walk away maybe the developer will finally listen and do something.
This is another case of a government that is supposed to work for its citizens failing them. I bet the developer is not only a resident of Dallas, but I bet they are not even from Texas.

Here are some common questions about the vaccine and answers from experts in the field.
Question: How effective is the vaccine?
Answer: The vaccine is almost 100 percent effective in protecting against four human papillomavirus types, which cause 70 percent of cases of cervical cancer and 90 percent of cases of genital warts.
Q: Why is it recommended for females ages 11 to 26?
A: The vaccine is most effective in girls who have not been exposed to any type of HPV. Research on the vaccine in women over 26 is now being conducted. Only if research shows that it is safe for that age group will the Food and Drug Administration consider approving the vaccine for women older than 26.
Q: Why aren't boys being vaccinated?

Just did some basic calculating and estimating how much Gov. Rick Perry just cost the Texas Tax Payer.
I estimate about $100 million per year. The HPV vaccine will cost the Tax Payer $360.00 dollars, $120.00 each, and it a three shot series.Based on about 3 million female students and 300,000 receiving the shot per year.
Thats to much money and to few actually getting a benefit, at taxpayer expense. It a nice thought. But to many conflicts and other issues that Taxpayer money needs to address for the benefit of all TEXANS. Before we spend this much money to protect less than 1000 to 2000 TEXANS.

I was unable to call in during your discussion on the HPV vaccine but have a few comments. First, let me establish that I do believe the vaccine should be given only with parental agreement. Also, the ties between Merck and Perry are troubling, at best.
However, the argument that all vaccines are given for communicable diseases is incorrect. Our children are now required to be immunized for Hepatitis B. Hepatitis B is transmitted through blood and infected body fluids. This can be accomplished by direct blood-to-blood contact, unprotected sex, and needle sharing. Most cases are transmitted by the latter two routes. I consider these routes of transmission to be behavioral, yet no one is up in arms about the fact that this, too, is a required vaccination.
Hepatitis B is a very debilitating disease, as is Cervical Cancer. I guess I just can't imagine that there is a vaccine available to prevent cancer causing HPV and people aren't lining up for it. (Virtually all cases of cervical cancer are caused by oncogenic HPV). Why wouldn't you want your child vaccinated? We are being given a chance to potentially eradicate a cancer - this is big stuff!!
Food for thought - if/when there is a vaccine for AIDS, should that be required as well??

Another HPV email
My biggest worry is that in 20 years girls will come up either sterile or having children with birth defects. I don' t think this has been studied enough. This has happened in the past, where our all-knowing government told us something was good for us and it ended up 20 years later with horrendous consequences. In the 50s or 60s women that took a certain drug that was supposed to be OK (I can't remember the name of it), ended up with children with horrible birth defects because of the drug. I don't want my grandchildren to have birth defects because of Governor Rick Perry mandating something that not all parents will research before allowing their daughters to have this vaccination. A lot of parents will go blindly into this deal and figure "well the government said so, so it must be OK."
Also, wasn't it Merck that had to have VIOXX pulled off the shelves because after everyone (the FDA included) said it was OK, it ended up giving people heart attacks? So their stock price is down and they need something to bring it back up again? Good work Mr. Perry -- you've helped the almighty drug company with your senseless, not studied enough mandate that affect all young women of Texas for the rest of their lives.

Some great info about HPV
HPV does NOT kill. It's a virus. Like a cold virus. The difference is that HPV is ONLY transmitted by sexual intercourse. Neither virus is deadly. Having HPV does NOT mean a women will get cervical cancer. Having the HPV vaccine does not prevent one from cervical cancer. It reduces the chances of acquiring HPV through unprotected sexual intercourse (or even protected sexual intercourse since condoms are not foolproof and don't cover all areas). The vaccine is not 100% effective; it has a failure rate. Getting the vaccine should not led anyone to believe that HPV is no longer an issue.
Additionally, the vaccine is effective on only four types of HPV, only two of which are potentially cancer-related. There are over 100 types of HPV and between 10-30% of those (as far as they know) have the possibility (not certainty) of causing cancer. Getting the vaccine is absolutely no assurance at all that one will not get HPV or cervical cancer.The vaccine is known to be effective for 4 years. That's right... FOUR YEARS. After that, it's a crap shoot. No one knows how long it may or may not last. Perry is not pushing for funding or research on how to stop boys from spreading HPV to girls.
The program as described thus far does not mention education, only vaccination. So, for those girls who do engage in unprotected sexual intercourse, having the vaccine without proper education could make one think she is protected against any sexually transmitted disease which is simply not true or that there's no way she'll get HPV or that there's no reason for regular pap smears since she's had the vaccine. Even the CDC tells men not to worry about having HPV even though the CDC mentions in passing that men are the ones who pass it on to women through unprotected sexual intercourse. How's that for a slap in the face to all women?HPV is not a huge public health risk like many proclaim. It is a very small risk. It's a very common STD, so common that most people who have it don't know it. So common that men are told quite literally by the CDC not to worry about it. (By the way, twice as many people in the US have the herpes virus than have HPV.) Cervical cancer kills fewer than 4000 women each year. Not all cases are caused by HPV. Lung cancer attributed to cigarette smoking kills 100 times that many people annually.... where's the mandate for everyone to stop smoking? The flu virus kills about 35,000 people each year... where's the mandate that everyone be vaccinated? Heart disease kills about 500,000 women each year; it is the #1 cause of death in women over age 35. Where's the push for mandatory exercise and weight control?
Additionally, the vaccine is too new. There haven't been enough long-term studies on efficacy and morbidity. It's just too risky.The best way to deal with this issue is education education education. Knowledge is far more powerful than any vaccine. And as evidenced on this thread alone, most people really don't know much about HPV or cervical cancer at all. Mandated vaccinations have been for preventing communicable diseases such as measles, diptheria, etc. That makes sense to require this for all school children in our schools. But I see no reason to allow a mandate for a vaccination for a non-communicable disease.

An email regarding no pass no play
"My son starting taking AP courses during the 2nd semester of his freshman year. He breezed through freshman English with an A, but was terribly bored and not challenged. He now takes half of his classes AP and is definitely NOT making A's. He struggles sometimes but would never give up on the classes because he likes being with kids who WANT to challenge themselves.
I worry about college acceptance when AP grades are B's and C's but I'm encouraged by words from his AP History teacher at our Open House this past Monday. He said that even if the grades are low, the AP classes are a better preparation for college classes. Students who don't learn at the AP level, he believes, have more difficulty in college classes - especially without parents there to help them.
It concerns me that we are making it easy for athletes (or whoever) to pass classes at lower levels and they are rewarded with scholarships. My son, on the other hand, is making an effort at higher learning but he won't be rewarded for that with a scholarship."
